Terms of Service.

Agreement to Terms

By accessing or using QW Web Solutions services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Service Plans

Managed Website Plan ($99/month)

• Minimum Commitment: New Managed Website builds require a 6-month minimum commitment.
• After Initial Period: The plan becomes month-to-month, and you may cancel at any time with 30 days notice.
• Early Termination: If canceled before 6 months, an early termination fee of 50% of the remaining balance applies.
• Included Services: Hosting, SSL, maintenance, updates, monitoring, and up to 2 content update requests per month.

Standalone Build ($1,699+)

• Payment: One-time payment with optional payment plan available.
• Ownership: Full code ownership upon final payment and project completion.
• Hosting: Optional managed hosting available for $25/month, or client-hosted deployment.

Payment Terms

We use Stripe as our payment processor. By using our services, you agree to Stripe's terms and conditions.

• All payments are processed securely through Stripe.
• All payments are due on the billing date specified in your invoice.
• We accept major credit cards, debit cards, and other payment methods supported by Stripe.
• Late payments may result in service suspension after 7 days.
• All fees are non-refundable except as required by law.
• Domain registration fees are billed separately at cost and are non-refundable.

Content Updates and Scope

Content updates under the Managed Website plan include text edits, image replacements, and minor layout adjustments.

The following are considered separate projects and quoted individually:

• Adding e-commerce functionality
• Major redesigns or structural changes
• Custom integrations or third-party services
• Additional pages beyond the initial scope

Domain Ownership

Your domain name is always registered in your name and remains your property. If we register a domain on your behalf, you retain full ownership and control. Upon request, we will transfer or release the domain to your preferred registrar at no charge.

Service Availability and Support

• We strive for 99.9% uptime but do not guarantee uninterrupted service.
• Support requests are handled during business hours (Monday through Friday, 9 AM to 5 PM EST).
• Emergency issues affecting site availability are addressed as quickly as possible.

Cancellation and Termination

You may cancel your Managed Website subscription with 30 days written notice after the initial 6-month commitment period. Upon cancellation:

• Your website will remain live through the end of your billing cycle.
• After the billing cycle ends, the website will be taken offline.
• You retain ownership of your domain name and content.
• We reserve the right to terminate services for non-payment or breach of terms.

Intellectual Property

Managed Website Plan: We retain ownership of the code and design during the subscription period. Upon conversion to a Standalone Build or full buyout, ownership transfers to you.

Standalone Build: Upon final payment, you own all code and design assets delivered as part of the project.

Limitation of Liability

QW Web Solutions is not liable for indirect, incidental, or consequential damages arising from the use or inability to use our services. Our total liability shall not exceed the amount paid by you in the 3 months preceding the claim.

Changes to Terms

We may modify these terms at any time. Significant changes will be communicated via email at least 30 days before taking effect. Continued use of our services after changes constitutes acceptance of the new terms.
